
{"id":2398,"date":"2025-03-11T11:18:45","date_gmt":"2025-03-11T17:18:45","guid":{"rendered":"https:\/\/cathykipp.com\/?page_id=2398"},"modified":"2025-08-01T10:56:39","modified_gmt":"2025-08-01T16:56:39","slug":"current-reproductive-rights-legislation","status":"publish","type":"page","link":"https:\/\/cathykipp.com\/index.php\/current-reproductive-rights-legislation\/","title":{"rendered":"Reproductive Rights Legislation"},"content":{"rendered":"\n<p>Current legal protections and ongoing legislation for pregnant people and reproductive rights<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Amendment 79<\/h2>\n\n\n\n<p>In the November 2024 Election, Colorado voters approved <strong>Amendment 79<\/strong> by 62%, which added a constitutional right to abortion to the state constitution.<\/p>\n\n\n\n<p>Amendment 79 enacted the following measures:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Repealed previous state constitutional amendment that prohibited the use of public funds to pay for abortions<\/li>\n\n\n\n<li>Recognizes the right to an abortion across the state of Colorado<\/li>\n\n\n\n<li>Prohibits Colorado state and local governments from denying, impeding, or discriminating against the exercise of the right to abortion<\/li>\n\n\n\n<li>Prohibits health insurance companies from excluding coverage for abortion<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">2025 Legislation for Reproductive Rights<\/h2>\n\n\n\n<p>Several bills have been passed this year that expand or ensure protections for reproductive rights:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a href=\"https:\/\/leg.colorado.gov\/bills\/sb25-183\" data-type=\"URL\" data-id=\"https:\/\/leg.colorado.gov\/bills\/sb25-183\" target=\"_blank\" rel=\"noreferrer noopener\"><span style=\"text-decoration: underline;\">SB25-183 &#8220;Coverage for Pregnancy-Related Services&#8221;<\/span><\/a><\/h3>\n\n\n\n<p><strong>Sponsored by Senators Robert Rodriguez &amp; Lindsey Daugherty<\/strong> <strong>and Representatives Lorena Garc\u00eda &amp; Julie McCluskie<\/strong><\/p>\n\n\n\n<p>Would make necessary changes to state law to conform to Amendment 79 by: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Requiring state authorization for Medicaid reimbursement for family-planning-related services<\/li>\n\n\n\n<li>Expanding the definition of &#8220;family-planning-related services&#8221; to include abortion care<\/li>\n\n\n\n<li>Requiring abortion care be added to the schedule of health-care services available for pregnant persons enrolled in the children&#8217;s basic health plan<\/li>\n<\/ul>\n\n\n\n<p><strong>STATUS:<\/strong> Signed into Law by Governor 4\/24<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/bills\/SB25-129\" data-type=\"URL\" data-id=\"https:\/\/leg.colorado.gov\/bills\/SB25-129\" target=\"_blank\"><span style=\"text-decoration: underline;\">SB25-129 &#8220;Legally Protected Health-Care Activity Protections&#8221;<\/span><\/a><\/h3>\n\n\n\n<p><strong>Sponsored by Senators Faith Winter &amp; Lisa Cutter and Representatives Junie Joseph and Karen McCormick<\/strong><\/p>\n\n\n\n<p>This bill would: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Allow providers&#8217; names to be excluded from medication abortion labels<\/li>\n\n\n\n<li>Prohibit compliance with out-of-state investigations that undermine legally protected health care in Colorado<\/li>\n\n\n\n<li>Expand protections for telehealth services<\/li>\n\n\n\n<li>Strengthen legal safeguards against abusive subpoenas<\/li>\n<\/ul>\n\n\n\n<p><strong>STATUS:<\/strong> Signed into Law by Governor 4\/24<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/bills\/sb25-130\" data-type=\"URL\" data-id=\"https:\/\/leg.colorado.gov\/bills\/sb25-130\" target=\"_blank\"><span style=\"text-decoration: underline;\">SB25-130 &#8220;Providing Emergency Medical Services&#8221;<\/span><\/a><\/h3>\n\n\n\n<p><strong>Sponsored by Senators Julie Gonzales &amp; Mike Weissman and Representatives Meg Froelich and Yara Zokaie<\/strong><\/p>\n\n\n\n<p>This bill affirms that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Emergency medical providers must offer life-saving care, including abortion and miscarriage care, without delay or uncertainty.<\/li>\n\n\n\n<li>Patients have a right to receive necessary emergency treatment under clear state protections.<\/li>\n\n\n\n<li>Payment details must be handled after emergency care is rendered.<\/li>\n<\/ul>\n\n\n\n<p><strong>STATUS: <\/strong>Signed into Law by Governor 5\/14<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><a rel=\"noreferrer noopener\" href=\"https:\/\/leg.colorado.gov\/bills\/hb25-1259\" data-type=\"URL\" data-id=\"https:\/\/leg.colorado.gov\/bills\/hb25-1259\" target=\"_blank\"><span style=\"text-decoration: underline;\">HB25-1259 &#8220;In Vitro Fertilization Protection &amp; Gamete Donation Requirements&#8221;<\/span><\/a><\/h3>\n\n\n\n<p><strong>Sponsored by Senators Lisa Cutter &amp; Lindsey Daugherty and Representatives Meg Froelich and Kyle Brown<\/strong><\/p>\n\n\n\n<p>This bill affirms that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Residents of Colorado have a right to fertility services and other assisted reproductive procedures<\/li>\n\n\n\n<li>A donor-conceived person has the right to contact the donor<\/li>\n\n\n\n<li>A donor has the right to engage or decline communication<\/li>\n<\/ul>\n\n\n\n<p>This bill would also:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Require donor banks to develop written informational materials for clients and customers<\/li>\n\n\n\n<li>Require donor banks to encourage donors to inform on significant medical history, and if provided, store this information and notify donation recipients in accordance with existing regulations<\/li>\n\n\n\n<li>Prohibit state and local governments from interfering or restricting a provider&#8217;s ability to provide IVF or other assisted reproductive procedures<\/li>\n<\/ul>\n\n\n\n<p><strong>STATUS: <\/strong>Signed into Law by Governor 5\/30<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Current legal protections and ongoing legislation for pregnant people and reproductive rights Amendment 79 In the November 2024 Election, Colorado voters approved Amendment 79 by 62%, which added a constitutional right to abortion to the state constitution.
