Know Your Rights: What to Do If You Are Approached by ICE
If you are confronted by ICE agents or individuals claiming to be representatives of immigration enforcement it is essential to know your rights.
Stay calm, don’t panic, remember the protections you have:
DO NOT OPEN YOUR DOOR WITHOUT A WARRANT
- If ICE knocks on your door, ask if they have a warrant before opening the door
- If ICE agents say they have a warrant, ask for it to be slid under the door or held up to a window for your examination
- ICE and other members of law enforcement cannot enter your home without a judicial warrant which has been signed by a judge
- ICE agents may attempt to show an administrative warrant (a warrant issued by ICE with no signature by a judge), you do not have to let ICE in with this kind of warrant

YOU HAVE THE RIGHT TO REMAIN SILENT
The Fifth Amendment protects your right to remain silent
- You do not have to answer questions about your immigration status, country of birth, how you entered the United States, etc.
- You can respond to any question with “I am exercising my right to remain silent”
YOU HAVE THE RIGHT TO AN ATTORNEY
- You have the right to legal representation
- If you are in need of representation, call 1-844-864-8341 (Colorado Rapid Response Hotline) to connect with legal services
- BEFORE hiring an immigration attorney, ensure they are members of the American Immigration Lawyers Association
- Search AILA members here
DO NOT SIGN ANYTHING WITHOUT LEGAL ADVICE
- ICE agents may attempt to pressure you into signing documents that waive your rights or may otherwise complicate future legal proceedings in their favor
- You have the right to speak with an attorney before signing any document
YOU DO NOT HAVE TO CONSENT TO A SEARCH
- ICE agents cannot search you, your belongings, or your vehicle without a judicial warrant or without receiving your permission
- You can simply say “I do not consent to a search”
- If ICE agents continue attempts to complete a search, repeat yourself and clearly communicate your lack of consent for the search
HAVE A PLAN
- If you or your family are at risk of facing detention, prepare an emergency plan for you/your family, including lining up legal representation, childcare arrangments, and compiling all available documentation
- Keep copies of important documents (examples listed below) in a safe, easily accessible place
- Important documents: IDs, immigration papers, emergency contact information, passports, medical documentation, etc.
